A. The Department of Administration shall consist of five (5) divisions, and such subdivisions, branches, and program offices necessary for the execution of each division’s mission, performance of its mandated functions, and to achieve its annual goals and objectives.

B. The five (5) divisions that comprise the Department of Administration shall be the Legal Division, the Personnel Division, the Administrative Division, the Financial Division, and the Operations Division.

1. The Legal Division shall be under the direction and control of the Attorney General.

2. The Personnel Division shall be under the direction and control of the Chief of Staff.

3. The Administrative Division shall be under the direction and control of the Chief Administrative Officer.

4. The Financial Division shall be under the direction and control of the Chief Financial Officer.

5. The Operations Division shall be under the direction and control of the Chief Operating Officer.

C. The Chief Administrative Officer, Chief Financial Officer, and Chief Operating Officer shall each constitute the Chief Director of their respective division.

D. Each division may employ staff professionals, support personnel, and/or contract with service professionals as the appropriate Chief Director, Chief of Staff or Attorney General shall determine, subject to the Tribe’s laws and the Tribe’s approved budget.

E. The Chief Directors and Chief of Staff shall:

1. Be under the direction of the Chairperson or, if appropriately delegated by the Chairperson, the Vice-Chairperson;

2. Oversee all other Executive Directors of other departments within their division, as created by Tribal Council;

3. Obtain express written consent of the Chairperson, and the Tribal Council if appropriate, prior to exercising oversight over any other tribal business entity; and

4. Be subject to the Tribe’s employment policies and laws, including, but not limited to, the Tribe’s human resources, conflicts of interest, code of ethics, and confidentiality policies.

F. The Department of Administration shall maintain a current organizational chart. The Chief of Staff and each Chief Director shall maintain the portion of the organizational chart associated with their division. The Chief Administrative Officer shall also maintain the portion of the organizational chart associated with the Legal Division. The organizational chart shall accompany the Chairperson’s annual budget submission and any requested budget modification.

G. The Chief Directors shall regularly collaborate to ensure the appropriate division or Chief Director is assigned any responsibilities, duties, obligations, steps, roles, benefits, accountability, or similar function or action that is assigned by Tribal law to the Department of Administration, Director of Administration, or similar general term that does not specify the particular division or Chief Director.
