Article IV. Workplace and Occupational Health and Safety Standards
§ 2-401 Workplace and occupational health and safety standards.
The Tribe does hereby adopt and make applicable to the gaming facility tribal workplace and occupational health and safety standards that are consistent with federal workplace and occupational health and safety standards.
A. The gaming operation shall permit inspection of gaming facility workplaces by state inspectors, during normal hours of operation, to assess compliance with applicable standards.
B. Notwithstanding the foregoing, no right to inspection by state inspectors shall be present when an inspection has been conducted by an agency of the federal government pursuant to federal law during the previous calendar quarter and the Tribe has provided a copy of the federal agency’s report to the state gaming agency within ten (10) days of the federal inspection.
