A. There is hereby established the Office of Development, Compliance, and Inspection, which shall be included within the Department of Administration.

B. The Office shall exercise the powers set forth herein. During any period in which there is no Building Official, the Office shall serve as the Building Official.

C. The Building Official shall report to the Department of Administration on a regular basis regarding building and safety matters on tribal land and such other matters as may be subject to this chapter. The Building Official may work on a full-time, part-time, or contract consultant basis as the Office shall determine.

D. The Office shall ensure that either the Building Official or one (1) or more designees, or a combination of them, shall include a certified and licensed building inspector or chief inspector.

E. The Building Official shall perform all permitting and inspections of all gaming facility construction to ensure that the construction complies with all requirements of the applicable codes. The Building Official is also authorized to enforce the applicable codes, including but not limited to issuance of citations for violations of the applicable codes, issuance of stop-work orders and any other enforcement mechanisms commonly used by building officials (or their equivalent) in other jurisdictions. For purposes of clarity, the Building Official is permitted to delegate any and all of the foregoing duties and powers to one (1) or more contracted designees. (Res. 2019-35)
