A. Employees shall be permitted to use accrued annual and sick leave to take tribal family leave for the following purposes:

1. The birth and care of the newborn child of an employee;

2. Placement with the employee of a child for adoption or foster care;

3. To care for an immediate family member with a serious health condition; or

4. To take medical leave when the employee is unable to work because of a serious health condition.

B. A combination of annual leave, sick leave, and leave without pay may be granted for a period of up to three (3) months for tribal family leave purposes.

C. The employee is responsible for making known in advance his or her intention to request tribal family leave including the type of leave, approximate dates, and anticipated duration in order to allow the Tribe time to prepare for any staffing adjustments which may be necessary.

D. The employee’s position may be filled on a temporary basis during the absence.

E. During the tribal family leave period, the employee will have reemployment rights to the former position or a position of similar rank and pay.

F. Tribal family leave can be granted up to three (3) months in a given twelve (12) month period (beginning on the date of the initial requested leave).

G. If an employee’s tribal family leave request exceeds a three (3) month period in a given twelve (12) month period, the Tribe reserves the right to terminate the employee. (Res. 2021-43; Res. 2019-50; Res. 2016-35; Res. 2014-17)
