A. Tribal employees shall not solicit or accept, directly or indirectly, any gift of value, if the gift could reasonably be expected to influence the vote, official actions or judgment of an elected official, public official or tribal employee, or could reasonably be considered a reward for any official action or inaction.

B. Tribal employees shall not use or attempt to use their position to influence or gain unlawful benefits, advantages or privileges personally or for their immediate family.

C. Tribal employees shall not accept privileges or benefits, other than those granted by the Tribe through official action, which may affect their ability to remain objective in the performance of his or her duties.

D. Tribal employees shall refrain from engaging in any of the following activities:

1. Entering into arrangements with tribal members for compensation in matters that are before the Tribal Council.

2. Engaging in negotiations with businesses or other governments doing business with the Tribe without the knowledge and authorization of the Chairperson or designee, Tribal Council or tribal enterprise board.

E. Tribal employees shall not knowingly or intentionally seek to, in any manner, benefit from the profits of any contract, job, work, or service for the Tribal Government or tribal enterprise, or accept any service or thing of value, directly or indirectly, upon more favorable terms than those granted to the public generally from any person, firm, or corporation having dealings with the Tribal Government or tribal enterprise.

F. Tribal employees shall not knowingly or intentionally seek to use their official influence to assist any person for a fee or other compensation other than the compensation that is provided by law. The performance of usual and customary member services without additional compensation does not constitute the use of prestige of office for private gain.

G. Tribal employees shall not accept a gift with a value of more than one hundred dollars ($100.00):

1. From a person seeking to obtain a contract, grant, loan, employment, or any financial relationship from or within the Tribal Government or tribal enterprise; or

2. From a person or business having a financial relationship with the Tribal Government or tribal enterprise.

H. It is not a violation for a tribal employee to accept gifts from clubs, conventions, conferences, special interest groups, school groups, and other gatherings as long as the gift is not cash.

I. A tribal employee may not accept an honorarium for participating in an extragovernmental event, ceremony, or similar function in their official capacity; provided, that he or she may accept an honorarium for participating in such event in their personal capacity and on their own time.
