A. This chapter shall be construed to be consistent with federal law and state law forbidding employment discrimination, and no less stringent than California law, except:

1. Nothing in this chapter shall preclude the Tribe or the Tribal Gaming Authority from giving preference in employment to members and descendants of federally recognized Indian tribes pursuant to tribal law and policy;

2. California law governing punitive damages is not a part of this chapter; and

3. Nothing in this section shall be construed as a submission of the Tribe or the Tribal Gaming Authority to the jurisdiction of the California Department of Fair Employment and Housing or the California Fair Employment and Housing Commission or any successor agencies thereto.

B. To the extent this chapter is inconsistent with any provision of 7 WRC § 1-101 et seq., Employment, as may be amended from time to time, this chapter shall prevail with respect to claims within the scope of this chapter. (Res. 2019-45)
