The Tribal Council hereby declares that any person violating any provision of this chapter is acting beyond the scope of their duties or authority and is therefore to be held personally liable for violations of this chapter. Notwithstanding Article XIII of the Constitution, the Tribe and its enterprises, officials, and employees shall not have the right to invoke, plead or otherwise assert sovereign immunity as a defense to any complaint or claim filed or any penalty or remedy assessed in any tribal administrative proceeding or in Tribal Court under this chapter.
