A. The success of the gaming operation relies on the trust and confidence of its employees.

B. The Tribe and the casino endeavor to take all reasonable precautions to protect the health, safety, and welfare of casino employees (referred to herein as “employees”).

C. The casino possesses sovereign immunity from legal action and, unless that immunity is expressly waived, employees will be unable to prosecute claims against the casino for work-related injuries.

D. The Tribe and the casino desire to create a process and exclusive remedy by which an employee who is injured on the job may be fairly compensated; provided, however, that no claim exceeding the limits of applicable insurance, or those excluded in this chapter, may be asserted.
