A. Article V, Section 1(a) of the Constitution grants the Chairperson the power to execute, administer, and enforce the laws of the Tribe.

B. Article VI, Section 2(a) of the Constitution grants the Tribal Council the power to make all laws, including resolutions, codes, and statutes.

C. Article VI, Section 2(c) of the Constitution grants the Tribal Council the power to pass laws regulating the Tribe’s elections, enrollment, employment, and all other matters so long as those laws are consistent with the Constitution.

D. Article VI, Section 2(f) of the Constitution grants the Tribal Council the power to authorize expenditures by law and appropriate funds in an annual budget.

E. Article VI, Section 2(g) of the Constitution grants the Tribal Council the power to raise revenue, including the power to levy and collect taxes and license fees.

F. Article VI, Section 2(i) of the Constitution grants the Tribal Council the power to require comprehensive reporting from the Chairperson regarding the Tribe’s finances, business, and other activities.

G. The Tribe through the tribal Revenue Allocation Plan, 1 WRC § 9-301(B)(2) has the power to appropriate, administer, and set aside funds under tribal control for the use and benefit of the general membership for general welfare programs pursuant to federal Internal Revenue Service Procedure 2014-35, including any subsequent federal Internal Revenue Service guidance under the Tribal General Welfare Exclusion Act of 2014 (codified as Internal Revenue Code Section 139E) for treatment as a tax-exempt benefit.
