A. Each gaming facility shall be constructed, maintained and operated in a manner that adequately protects the environment and the health and safety of the public.

B. The Tribe shall prohibit persons under the age of twenty-one (21) years from being present in any room or area in which gaming activities are being conducted unless the person is en route to a nongaming area of the gaming facility, or is employed at the gaming facility in a capacity other than as a gaming employee.

C. The possession of firearms by any person in the gaming facility is prohibited at all times, except for federal, state, or local law enforcement personnel, or tribal law enforcement or security personnel authorized by tribal law and federal or state law to possess firearms at the gaming facility. Any regulation promulgated by the Gaming Commission which allows for the possession of firearms within the gaming facility shall be in compliance with the tribal-state compact and this chapter, and shall require that adequate liability insurance shall be obtained by the gaming operation with respect to possession of firearms.

D. The Gaming Commission shall identify and enforce laws, resolutions, codes, policies, standards, or procedures which are applicable to each gaming facility, to ensure adequate protection of the environment and the health and safety of the public. (Res. 2019-28)
