“Alcoholic beverage” means all alcohol, spirits, liquor, wine, beer and any liquid or solid containing alcohol, spirits, wine, or beer, and which contains one-half of one percent (0.5%) or more of alcohol by volume and which is fit for beverage purposes, either alone or when diluted, mixed, or combined with any other substance(s).

“Board” means the Liquor Control Board established under Article II of this chapter.

“Gaming compact” means the tribal-state gaming compact between the state of California and Wilton Rancheria, as may be amended from time to time.

“Legal age” shall have the meaning set forth in Section 5-113.

“Manufacture” means the production of alcoholic beverages for the purpose of selling to a person whether licensed or unlicensed.

“Person” means any individual or entity, whether Indian or non-Indian, receiver, assignee, trustee in bankruptcy, trust, estate, firm, corporation, partnership, joint corporation, association, society, or any group of individuals acting as a unit, whether mutual, cooperative, fraternal, nonprofit or otherwise, and any other Indian tribe, band or group. The term shall also include the businesses of the Tribe.

“Sale” or “sell” means the transfer of an alcoholic beverage for consideration of any kind, including by exchange or barter, from one (1) person to another.

“State” means the state of California.

“Retail sale” means the sale of an alcoholic beverage to a consumer for consumption on or off the licensed premises and not for resale.

“Tribal Council” has the same meaning as under Article VI of the Constitution.

“Tribal lands” means all territory set forth in Article II, Section 1 of the Constitution.

“Tribe” means the Wilton Rancheria.

“Wholesale” or “wholesale sale” means the sale of an alcoholic beverage to any licensee for purpose of resale. (Res. 2018-69)
