A. This chapter shall be liberally construed and applied to promote its underlying purpose and policy.

B. The underlying purpose and policy of this chapter are:

1. To improve access to reasonably priced capital by the Tribe as well as agencies, tribal corporations, enterprises, subdivisions, components and other instrumentalities of the Tribe;

2. To promote economic development and expansion of commercial practices within the exterior boundaries of the lands over which the Tribe exercises governmental power; and

3. To make the law among the various jurisdictions more uniform, while ensuring notice and fair business dealings between the parties to secured transactions.

C. The effect of provisions of this chapter may be varied by agreement, except as otherwise provided in this chapter and except that the obligations of good faith, diligence, reasonableness and care prescribed by this chapter may not be disclaimed by agreement, but the parties may by agreement determine the standards by which the performance of such obligations is to be measured if such standards are not manifestly unreasonable.
