§ 9-305 Per capita pay period.
Per capita distribution shall commence according to the outline below.
A. Per capita distributions shall begin after the gaming operation has opened to the public for the purpose of gaming and has generated and distributed net distributable cash to the Tribe for at least two (2) fiscal quarters.
B. Once per capita distributions have begun, each fiscal quarter a payment will be made based on the net distributable cash from two (2) fiscal quarters prior. (See examples below.)
1. The third fiscal quarter distribution will be based upon the first fiscal quarter’s net distributable cash.
2. The first fiscal quarter distribution will be based upon the previous third fiscal quarter’s net distributable cash.
C. Distributions shall be made on the first day of the fiscal quarter; provided, that the per capita payment shall be paid on the business day prior to the first day of the fiscal quarter whenever the first day of the fiscal quarter falls on a holiday or weekend day. (Res. 2021-56; Res. 2021-19)
