To advance the personal health, safety, and welfare of tribal members and the Tribe, and to promote desired positive conduct, per capita payment(s) will be forfeited while any person is incarcerated as provided in Section 9-401(F). The Tribe desires to provide for the future health, education and welfare of incarcerated eligible tribal members by directing one hundred percent (100%) of the amount otherwise distributable to such incarcerated tribal members as a per capita payment to be placed in a tribal account to fund and support tribal programs for which incarcerated and other tribal members are eligible. Notwithstanding the forfeiture with respect to per capita payments, incarcerated tribal members may apply for and participate in other general welfare program benefits referred to in this chapter and any other applicable Tribal Governmental programs pursuant to tribal law.
