A. The filing party must file a proof of service declaration stating that the filed documents were delivered to the other parties.

B. The person over the age of eighteen (18) must serve the papers and must complete and sign a proof of service declaring under penalty of perjury that they served the party including:

1. The name of the person delivering (serving) the papers.

2. The time and date the documents were served.

3. The names of the parties who were served.

4. The name of the documents served.

5. The method of delivery of the documents (personal service, mail, email, etc.).

6. The address where the documents were delivered, or the address of service or attempted service, if service was unsuccessful.

7. The following would satisfy this requirement:

I, [name of person mailing the document], am over the age of eighteen (18) and certify that at [time] on [date] I delivered to [other party] a true and correct copy of the [name of document filed] by [state method of delivery] to [address]. I swear under penalty of perjury under the laws of the Wilton Rancheria that the foregoing statement is true and correct to the best of my knowledge.

C. For service by certified mail, the signed return receipt or online confirmation of delivery on the United States Postal Service website will serve as confirmation that service was successful. For other third-party delivery services, the online confirmation of delivery from that service’s website will serve as confirmation that service was successful. The Court Clerk must enter into the record the signed return receipt or a declaration of proof of service with the online confirmation attached. Service will be deemed completed as of the date of signature or delivery confirmation, whichever is later.

D. For service by publication, a certificate of publication from the newspaper publishing the summons or actual clippings from the newspaper will serve as confirmation of service of process. The Court Clerk must enter into the record the certificate of publication from the newspaper or a declaration of proof of publication with the newspaper clippings attached. Copies generated from a digital edition of the newspaper publication will be treated as original clippings. Service will be deemed completed as of the last date of publication.

E. The Court may allow a proof of service of process to be amended to conform to these rules or applicable law, unless it determines that the party would be seriously disadvantaged by such amendment, in which case the Court may make any order to accomplish substantial justice.
