A. A disciplinary proceeding commences when a party to a case in Tribal Court (active or closed) or the Court files a formal complaint against the member (referred collectively as “respondent member”). Once filed, the Court Clerk shall generate a summons containing a hearing date and time and advising the respondent member of their rights.

B. After the formal complaint is filed, it must be personally served on the respondent member or their attorney of record with the summons notifying him or her that they have twenty (20) days to file a written response.

C. The formal complaint must state the respondent’s acts or omissions in sufficient detail to inform the respondent of the nature of the allegations of misconduct. The investigative officer must sign the formal complaint, under penalty of perjury.

D. Prior disciplinary action against the respondent should be included in a supporting declaration if the respondent is charged with conduct demonstrating unfitness to practice law. (Res. 2020-70)
