There shall be no right to appeal decisions made under this rule. A member who has been determined to have committed a violation under this rule who wishes to have a decision reviewed can submit a motion for reconsideration to the Tribal Court. The motion for reconsideration will be processed in the same way as any other motion. The motion, decision and record of the proceeding shall be forwarded to the Appellate Chief Judge who shall assign only one (1) judge from the Appellate Panel to review and consider the motion. The judge assigned shall decide if a hearing is needed or if the motion can be decided on the record. If the decision is affirmed the Appellate Judge may order additional Court costs as part of the decision. (Res. 2020-70)
