Unless otherwise provided by tribal law, the burden of proving a claim shall be on the party making the claim to prove his or her case by a preponderance of the evidence, which means the claim is more likely than not true. A party shall be considered to have met the burden of proof if most of the evidence presented tends to prove that party’s claim. (Res. 2021-43; Res. 2020-60)
