The following definitions shall be applicable with respect to the interpretation of this chapter. All other words shall have their commonly understood definition.

“Burial benefit” means the financial assistance for tribal families and members provided by the burial fund and program established by the Tribe to assist with the costs incurred for memorial services, funeral services, and burial of eligible enrolled tribal members, eligible family members, and other eligible community members.

“Burial fund” means the fund established by the Wilton Rancheria Tribal Council pursuant to the tribal budget from which burial benefits are paid.

“Eligible” means:

1. A tribal member that dies after being enrolled in the Tribe;

2. A deceased person who was the legal spouse of an enrolled member of the Tribe at the time of the spouse’s death and immediate family of tribal member (parents, spouse or siblings);

3. A child aged eighteen (18) years or younger at death that is a member of a tribal household and the tribal member is the legal parent or guardian;

4. Nonmember but a member of the Native American community.

“Funeral services provider” means the establishment where deceased persons are prepared for burial and where funeral services are held. There can be more than one (1) funeral services provider.

“Memorial, funeral, and burial service” means any product or service provided for the memorial, funeral ceremony, burial, internment, or cremation of an eligible deceased.

“Representative” means the contact person for assuring the memorial, funeral, and burial services are provided to and paid for the eligible deceased. Only one (1) representative may be designated. To serve as a representative, a person must be at least eighteen (18) years of age and be:

1. The spouse of the eligible deceased; or

2. A relative of the eligible deceased; or

3. A person who has the legal authority to administer the eligible deceased’s estate.

In the event of a dispute regarding who shall serve as representative, the list above shall serve as the order of preference. No burial benefits may be disbursed until all such disputes are settled and a single representative has been selected.

“Tribal member” means a person who is included on the Tribe’s official membership roll as a member of Wilton Rancheria pursuant to the Constitution of Wilton Rancheria and 4 WRC § 2-101 et seq., Enrollment and Membership.

“Tribe” means Wilton Rancheria. (Res. 2015-17)
