A. The Tribal Council will be responsible for reviewing the final TEA, TEIR, STEIR or PEIR and all relevant facts, including comments received and response to comments. If the Tribal Council is satisfied that it is fully informed as to all relevant information from the final TEA, TEIR, STEIR or PEIR, the Tribal Council will make one (1) of the following decisions:

1. Adopt the final TEA, issue a finding of no significant impact, also known as a FONSI, and approve the gaming project, lease, or development project;

2. Adopt the final TEIR, STEIR or PEIR and approve the gaming project, lease, or development project; or

3. Adopt the final TEIR, STEIR or PEIR but not approve the gaming project, lease, or development project.

B. Whichever action the Tribal Council takes will be in the form of a written resolution, which, together with all supporting documentation and information, shall constitute the Tribe’s record of decision for the gaming project, lease, or development project in question. Any such resolution by which the Tribal Council approves a gaming project will include findings that a good-faith effort shall be made to cause the stated mitigation measures to be implemented, even if some of those mitigation measures are within the responsibility and jurisdiction of another agency.

C. There will be no appeal from the Tribal Council decision, whose action is final for the Tribe. (Res. 2019-40)
