A. There shall be an Enrollment Committee established within the Department of Administration.

B. Duties and Authority.

1. The Enrollment Committee shall process all applications for membership in the Tribe.

2. The Enrollment Committee shall issue letters to each new member of the Tribe after the enrollment process has been successfully completed. Such letters shall bear the signature of both the Chairperson and the Spokesperson of the Enrollment Committee.

3. The Enrollment Committee shall issue letters to each individual denied membership in the Tribe.

4. The Enrollment Committee shall begin proceedings for the removal of individuals erroneously included on the membership roll by mistake or fraud.

5. Members of the Enrollment Committee shall attend meetings of the Enrollment Committee and those Enrollment Committee hearings required by this chapter.

6. The Enrollment Committee shall maintain confidentiality of all membership information. Each individual member of the Enrollment Committee shall sign an agreement to maintain confidentiality regarding all Enrollment Committee proceedings and records.

C. Qualifications. Members of the Enrollment Committee shall be at least twenty-five (25) years of age and shall not have been convicted of a felony.

D. Enrollment Committee Membership.

1. The Enrollment Committee shall consist of five (5) to seven (7) members of the Tribe appointed by the Chairperson and confirmed by Tribal Council on or before January 31 of each odd-numbered calendar year.

2. Tribal Council may appoint, by resolution, one (1) Council member to serve as ex officio member of the Committee. Such ex officio member will serve until his or her Council term expires, he or she resigns from the Board, or his or her appointment is revoked by Tribal Council.

3. Each of the members of the Enrollment Committee shall be a lineal descendant of a different distributee listed in the Tribe’s A Plan for Distribution of the Assets of the Wilton Rancheria, According to the Provisions of Public Law 85-671, Enacted by the 85th Congress, Approved August 18, 1958, as approved by the deputy commissioner of the Interior Department’s Bureau of Indian Affairs on July 6, 1959.

E. Selection Process. The Chairperson shall utilize the following selection process to fill any vacancy on the Enrollment Committee, whether that vacancy occurs because of the expiration of a term, removal or resignation from the Enrollment Committee, or any other reason:

1. Notice.

a. The Chairperson shall provide notice of any known upcoming vacancies on the Enrollment Committee during the annual General Council meeting.

b. The Chairperson shall publish notice of any upcoming vacancies on the Enrollment Committee in the Tribe’s newsletter and on the Tribe’s website to the extent practicable.

2. Chairperson.

a. The Chairperson shall require that applicants for the Enrollment Committee should submit a letter of application.

b. The Chairperson shall make a tentative selection for the Enrollment Committee and conduct a felony background check on that tentative selection prior to officially appointing the individual to the Enrollment Committee.

F. Terms.

1. Members of the Enrollment Committee shall serve two (2) year terms, and their terms shall expire on December 31 of the second year following their appointment.

2. Members of the Enrollment Committee may be reappointed for additional terms.

3. The Chairperson shall have the authority to remove any member of the Enrollment Committee for good cause.

4. The Chairperson shall remove any member of the Enrollment Committee that misses more than two (2) meetings during either the first or second year of the member’s term. However, the Chairperson may make exceptions for members of the Enrollment Committee who may provide proof of medical emergency or of other good cause.

5. The Chairperson shall provide notice to the Tribal Council any time a vacancy occurs on the Enrollment Committee for any reason and shall provide detailed reporting to the Tribal Council of the reasons for the removal of a member of the Enrollment Committee by the Chairperson.

G. Committee Spokesperson.

1. The Enrollment Committee shall select its Spokesperson from among its membership.

2. The Spokesperson of the Enrollment Committee shall, subject to administration and direction from the Chairperson, supervise the business and the officers of the Committee. The Spokesperson shall preside at all meetings of the Committee. The Spokesperson shall prepare an agenda for each meeting and shall prepare a monthly written report to the Chairperson regarding the business of the Committee.

H. Committee Secretary.

1. The Enrollment Committee shall select its Secretary from among its membership.

2. The Secretary of the Enrollment Committee shall give notice of all meetings to other members of the committee. The Secretary shall take roll at every meeting, and maintain a record of all members’ attendance at such meetings.

3. The Secretary shall ensure that a book or binder of minutes of all meetings and actions by the Enrollment Committee is maintained by the Office of Enrollment.

I. Compensation.

1. Members of the Enrollment Committee shall be compensated for attendance at committee meetings and hearings at a rate established by the Tribe’s budget.

2. A member of the Enrollment Committee must be present for a majority of the meeting or hearing to receive compensation.

J. Quorum.

1. Quorum for the Enrollment Committee shall be three (3).

2. Quorum must be attained and maintained to conduct business and for the Enrollment Committee members to be eligible for compensation.

K. Committee Procedures. The Enrollment Committee will submit to Tribal Council, for approval, the bylaws, rules or procedures. The Tribal Council will have forty-five (45) days from first formal presentation to Tribal Council at a duly called Tribal Council meeting to modify, amend, accept, or reject the bylaws, rules or procedures. In accordance with 4 WRC § 1-101 et seq., Tribal Council, as amended, the Tribal Council may accept or reject the bylaws, rules or procedures as submitted to Tribal Council by motion, and may approve the bylaws, rules or procedures as modified by Tribal Council by resolution. If Tribal Council does not act within forty-five (45) days, the bylaws, rules or procedures shall be deemed approved.

1. The bylaws, rules or procedures must be completed and presented to Tribal Council within forty-five (45) days of enactment of any amendments to this chapter. (Res. 2019-47; Res. 2014-31; Res. 2013-16; Res. 2012-33)
