A. A member of the Tribe who is discovered by clear and convincing evidence to have been erroneously conferred membership in the Tribe by mistake or fraud pursuant to the provisions of this chapter or the Constitution shall be subject to removal from the Tribe’s membership roll.

B. The Enrollment Committee shall initiate a removal from the membership roll by notifying the member by certified mail, return receipt requested, of the Tribe’s intent to remove the member from the membership roll and of the information that brought the action.

C. The Enrollment Committee shall establish a hearing date for the matter, provide at least a thirty (30) day notice to the member of the hearing date, and render a decision on the matter. If the member fails to appear for the scheduled hearing, the Enrollment Committee may render a decision in the absence of further evidence or testimony in the matter.

D. The Enrollment Committee’s decision will be appealable to the Tribal Court. (Res. 2019-47; Res. 2014-31; Res. 2013-16; Res. 2012-33)
