A. Article V, Section 3 of the Constitution provides that the Chairperson and Vice-Chairperson shall serve staggered four (4) year terms.

B. Article V, Section 3 of the Constitution provides that the Vice-Chairperson elected in 2012 shall serve only until the 2014 general election.

C. Article VI, Section 2 of the Constitution authorizes the Tribal Council to make the Tribe’s laws.

D. Article VI, Section 2(a) of the Constitution grants the Tribal Council the power to make all laws, including resolutions, codes, and statutes.

E. Article VI, Section 2(c) of the Constitution grants the Tribal Council the power to pass laws regulating the Tribe’s elections, enrollment, employment, and all other matters so long as those laws are consistent with the Constitution.

F. Article VI, Section 2(e) of the Constitution grants the Tribal Council the power to appoint members of the Election Commission.

G. Article VI, Section 5 of the Constitution provides that members of the Tribal Council shall serve four (4) year terms which shall be staggered.

H. Article VI, Section 5 of the Constitution provides that the three (3) Tribal Council members receiving the lowest percentage of votes in the Tribe’s 2012 general election shall serve only until the 2014 general election.

I. Article IX, Section 1 of the Constitution provides that general elections shall be held during the second weekend in June of even-numbered years beginning in 2014. General elections shall be held in conjunction with the General Council’s annual meeting. All elected officials shall take office on the Monday immediately following the election.

J. Article IX, Section 1 of the Constitution provides that the Chairperson, Vice-Chairperson, and members of the Tribal Council shall be selected at the general elections.

K. Article IX, Section 2 of the Constitution provides that runoff elections shall be held during the second weekend in June of even-numbered years beginning in 2014 for all general election races which end in a tie or in which the Chairperson or Vice-Chairperson fails to obtain more than a majority of the vote. A runoff election shall include only the two (2) individuals who have tied in any race or the two (2) candidates who have received the highest number of votes in the election for Chairperson or Vice-Chairperson.

L. Article IX, Section 3 of the Constitution provides that any member of the Tribe who is at least eighteen (18) years of age on the date of the election shall have the right to vote.

M. Article IX, Section 4 of the Constitution provides that the Wilton Rancheria Election Commission shall be an autonomous and permanent entity charged with the administration of the Tribe’s elections in accordance with the Constitution and the Tribe’s election laws.

N. Article IX, Section 4 of the Constitution provides that prior to each election, the Tribal Council shall appoint all members of the Election Commission.

O. Article IX, Section 4 of the Constitution provides that the Tribal Council will enact laws which will govern the conduct of all elections.

P. Article IX, Section 4 of the Constitution provides that Commission members appointed by the Tribal Council shall serve only until the results of the next general election are certified. However, Commission members may be reappointed.
