The following definitions shall be applicable with respect to the interpretation of this chapter regardless of whether the defined term is capitalized. All other words shall have their commonly understood definition.

“Act” means this chapter, as amended from time to time.

“Anything of value” means any money or property, favor, service, payment, advance, forbearance, loan, gift, or promise of future employment, but does not include compensation and expenses paid by the Tribe, fees and expenses which are permitted, or hospitality extended for a purpose unrelated to the Tribe’s business by a person other than an organization.

“Associated,” when used with reference to an organization, includes any organization in which an individual or a member of his or her immediate family is a director, officer or trustee, or owns or controls any organization, directly or indirectly.

“Business” means any enterprise, organization, trade, occupation or profession, whether or not operated as a legal entity for profit, including any business, trust, holding company, corporation, partnership, LLC, joint venture, or sole proprietorship, consultant or other self-employed enterprise.

“Business with which the person is associated” means any business in which the person is a director, officer, partner, trustee or employee, holds any position of management or receives income in any form such as wages, commission, direct or indirect investment worth more than one thousand dollars ($1,000.00) or holds any ownership, security or other beneficial interest, individually or combined, amounting to more than ten percent (10%) of said business.

“Compensation” or “income” means any money or thing of value received, or to be received as a claim on future services, whether in the form of a fee, salary, expense, allowance, forbearance, forgiveness, interest, dividend, royalty, rent, capital gain, or any other form of recompense or any combination thereof.

“Confidential information” means information that by law or practice is not available to the public at large.

“Conflict of interest” means the reasonable likelihood that an elected official or tribal official is in a position to derive personal benefit from actions or decisions made in their official capacity.

“Constitution” means the Constitution of Wilton Rancheria.

“Dependent business” means any business in which the person, individually or combined, has any direct or indirect ownership, investment, security or other beneficial interest amounting to more than ten percent (10%) of such business.

“Economic interest” means an interest held by a person, members of the person’s immediate family living in the same household or a dependent business, as defined in this section, which is:

1. Any ownership, income, investment, security or other beneficial interest in a business; or

2. Any employment or prospective employment for which negotiations have already begun.

“Elected office” means any office regularly filled by a vote of the members of Wilton Rancheria.

“Elected official” means the Chairperson, Vice-Chairperson, and Tribal Council members, including any Council members who have been appointed pursuant to Article X, Section 2 of the Constitution.

“Employee” means any person or entity working for, or rendering or exchanging any services or performing any act for, or on behalf of, another person, organization or entity in return for any form of pay or other compensation, or thing of value received, or to be received, at any time temporarily, permanently, or indefinitely in any capacity whether as agent, servant, representative, consultant, advisor, independent contractor or otherwise.

“Employment” means the status or relationship existing or created by and between a person acting as an employee, and the person, organization, group or other entity for whom or on whose behalf any such work, acts, services or other benefit has been, is being, or will be rendered or performed for pay or any other form of compensation.

“Gift” means any gratuity, favor, hospitality, payment, loan, economic opportunity, deposit of money, services, or other benefit received without equivalent consideration and not extended or provided to members of the public at large.

“Honorarium” means a monetary payment given for professional services that are rendered nominally without charge.

“Immediate family” means husband, wife, son, daughter, stepson, stepdaughter, father, stepfather, father-in-law, mother, stepmother, mother-in-law, brother, stepbrother, brother-in-law, sister, stepsister, sister-in-law, child, stepchild, son-in-law, or daughter-in-law, or a person whose relationship with the tribal member is similar to that of the persons listed within this definition.

“Materiality” means a characteristic of evidence that has some logical connection to a fact of consequence to the outcome of a case.

“Probative force” means a characteristic of evidence that provides proof of a specific matter at issue.

“Relevancy” means a characteristic of evidence that has a tendency to make the existence of any fact that is of consequence to the determination of the action more probable or less probable than it would be without the evidence.

“Tribal official” means any person who holds office in the Tribe, including Gaming Commissioners, members of the Election Commission, members of any other tribal committee, commission or board, and members of any tribal enterprise board, whether or not they are paid or receive stipends or per diems for their committee, commission or board service.
