As used in this chapter, the terms set forth below shall have the following meanings (as defined under the compact):

“City” means the city of Elk Grove, California.

“Class III gaming” means the forms of Class III gaming defined in 25 U.S.C. § 2703(8) and by the regulations of the National Indian Gaming Commission.

“Compact” means the tribal-state gaming compact between the state of California and the Tribe, as it may be amended from time to time.

“County” means the county of Sacramento, California, a political subdivision of the state.

“Gaming facility” means any building in which Class III gaming activities or gaming operations occur, or in which the business records, receipts, or other funds of such gaming operation are maintained (but excluding off-site facilities primarily dedicated to storage of those records and financial institutions), and all rooms, buildings and areas, including parking lots and walkways, a principal purpose of which is to serve the activities of a gaming operation.

“Gaming operation” means the business enterprise that offers or operates the Class III gaming activities authorized under the compact.

“Indian lands” means all lands of the Tribe within the limits of the Tribe’s reservation and land over which the Tribe exercises governmental power and that is either held in trust by the United States for the benefit of the Tribe or a tribal member.

“State” means the state of California.

“State gaming agency” means the entities authorized to investigate, approve, regulate and license gaming pursuant to the state Gambling Control Act, Chapter 5 (commencing with Section 19800) of Division 8 of the California Business and Professions Code, or any successor statutory scheme, and any entity or entities in which that authority may hereafter be vested.

“Tribal Council” means the duly elected governing body of the Tribe pursuant to the Tribal Constitution.

“Wilton Gaming Commission” means the gaming regulatory body of the Tribe established pursuant to 1 WRC § 3-101 et seq., Gaming Ordinance. (Res. 2023-04; Res. 2019-34)
