Article II. Food and Beverage Handling

The Tribe does hereby adopt and make applicable to the gaming facility the public health standards of the state of California for food and beverage handling.

A. Inspection of food and beverage services in the gaming facility may be conducted by state or county health inspectors, who provide evidence of authority demonstrating that they would have jurisdiction, but for the gaming facility being on Indian lands, to assess compliance with these standards, unless such inspections are routinely made by an agency of the United States to ensure compliance with equivalent federal standards.

B. Any report or other writing received by the Tribe subsequent to an inspection or visit by state, county or federal health inspectors shall be transmitted by the Tribe within three (3) business days to both the state gaming agency and the Wilton Gaming Commission.

C. Nothing herein shall be construed as submission of the Tribe to the jurisdiction of those federal or state health inspectors, but any violations of the standards may be the subject of compact dispute resolution per Section 13.0 of the compact. (Res. 2019-34)
