§ 3-205 Orders appointing a guardian.
A. The Tribal Court shall state the following in all orders appointing a temporary guardian:
1. The justification for appointing a temporary guardian;
2. The duration of the temporary guardianship, including any circumstances that may automatically terminate the temporary guardianship;
3. The responsibilities and duties of the temporary guardian;
4. The ability of the temporary guardian to use the protected individual’s funds or property;
5. Any reporting or accounting requirements regarding the temporary guardian’s use of the protected individual’s funds or property.
B. The Tribal Court shall state the following in all orders appointing a permanent guardian:
1. The justification for appointing a guardian;
2. The duration of the guardianship, including any circumstances that may automatically terminate the guardianship;
3. The responsibilities and duties of the guardian;
4. The ability of the guardian to use the protected individual’s funds or property;
5. Any reporting or accounting requirements regarding the guardian’s use of the protected individual’s funds or property;
6. The frequency of review hearings;
7. Any requirements to allow visitation with the protected individual’s family;
8. Any requirements for maintaining connection with the Tribe and attendance at tribal and cultural events;
9. Any requirements to develop and comply with a wellness plan; and
10. The responsibilities and duties of any interested parties, including any orders for support, which may include deductions from the interested parties’ per capita distributions. (Res. 2023-60)
