A. The purpose of these modifications is to address unanticipated expenses, over-expenditures in specific line items and department programs beyond the control of the Chairperson, and the addition of programs or activities not anticipated or planned during budget preparation.

B. The Chairperson or Chief Judge may review and approve any proposed minor budget modification. Each proposed budget modification shall contain full documentation and written justification for the modifications.

C. When any proposed major budget modification is necessary, and before any reallocation, expense or acceptance is incurred, the Chairperson or Chief Judge must submit the proposed major budget modification to the Tribal Council for review and consideration. Each proposed budget modification shall contain full documentation and written justification for the modifications.

D. The Tribal Council may accept and act on a major budget modification proposed by the Chairperson or Chief Judge at any time if, by motion duly made and accepted, the Tribal Council determines that consideration and action on one (1) or more modifications out of the normal procedural sequence, as outlined in this section, is in the best interest of the Tribe under the circumstances.
