§ 7-106 Applicability of this chapter to prior transactions.
The provisions of this chapter shall be applicable to all security interests granted by the Tribe or by any agency, tribal corporation, enterprise, subdivision, component or other instrumentality of the Tribe prior to the enactment of this chapter, except that the law applicable to any such security interest on the date such security interest was granted shall apply:
A. To the attachment, perfection and priority of such security interest; provided, however, that if any such security interest is unperfected under such law or if such law does not otherwise recognize the perfection of such security interest, and the provisions of this chapter do recognize the perfection of such security interest, the provisions of this chapter shall nonetheless apply to such security interest; and
B. In any other respect, to the extent application of this chapter would impair contractual rights vested in any party other than the Tribe or any agency, tribal corporation, enterprise, subdivision, component or other instrumentality of the Tribe. (Res. 2019-18)
