In accordance with all applicable laws, including written notice to the eligible tribal member and an adjusted statement of account, the following claims shall be recognized and enforced by the Tribe against a per capita payment at the time a per capita distribution occurs to an eligible tribal member:

A. Any debt or monies then due owing by a tribal member for violations of tribal law(s) or for satisfaction of other claims asserted by the Tribe which:

1. Has been established by order of the Tribal Court permitting recovery from such tribal member’s per capita payment; or

2. Is stated in writing signed by the tribal member and in which the tribal member has agreed in writing may be recovered from his or her per capita payment upon delinquency, default or other event.

B. Otherwise as permitted pursuant to tribal law. (Res. 2021-56; Res. 2021-19)
