A. Tribal Council will appoint an Appellate Chief Judge to preside over the Appellate Panel.

B. The Appellate Chief Judge will select two (2) other Appellate Judges appointed by Tribal Council to sit as an Appellate Panel.

C. The Appellate Chief Judge is responsible for developing and maintaining the Rules of Appellate Procedure.* Such rules must be submitted to Tribal Council for review. Upon submission, Tribal Council will have forty-five (45) days to modify, adopt, or reject the proposed rules. If the Tribal Council does not act within forty-five (45) days, the rules will be deemed approved. The rules shall be codified as part of the Tribe’s Judicial Code.
