In the absence of controlling tribal law, any suitable process may be adopted by the Court that is consistent with the spirit of tribal law and these rules. The Court may consider tribal traditions and customary law, the laws of another tribe in California, the laws of any other tribe, federal law, and California law. The Court must make clear findings and orders supporting the application of any law other than those stated in this code and ensure all parties have notice of the application of the nontribal law.
