The Courts may invoke the rule of necessity, which requires a judge or panel of judges who normally would be required to recuse themselves under this rule but must continue to preside over the matter despite the presence or appearance of a conflict when there are no other alternative tribunals or judges available to preside over the matter, resulting in no judge or panel able to hear the matter and depriving the parties of their right to have their dispute heard.
