A. The Traditional Court has jurisdiction over matters referred to it by the Chief Judge involving a tribal member, tribal employee or the Tribe.

B. If the Traditional Court determines that the peacemaking process cannot produce an agreed resolution of the matter, the Traditional Court will transfer the case back to the Tribal Court, which shall resume jurisdiction over the case.

C. In addition to the referral of a case to the Traditional Court, the Chief Judge may certify specific questions regarding tribal customs and traditions to the Traditional Court as needed in cases in which the Tribal Court retains jurisdiction. (Res. 2022-24 (Exh. A))
