§ 4-317 Standard of review.

A. The Tribal Court shall accept all factual findings of the Election Commission unless they are clearly erroneous.
B. The Tribal Court shall make its determination based on the record of the Election Commission, including the investigation(s), if any were performed, and the formal administrative hearing.
C. The Tribal Court may overturn the decision of the Election Commission if the decision was arbitrary, capricious, contrary to law or not supported by the record. (Res. 2021-54; Res. 2020-14; Res. 2015-24; Res. 2014-41; Res. 2013-60; Res. 2013-57)
