A. Pursuant to Article X, Section 3 of the Constitution, persons appointed or elected to fill a vacancy shall serve only until the Tribe’s next general election.

B. If a vacancy occurs with respect to a position that would not have been up for election during the next general election, the individual elected to fill the position during the next general election will serve for only the two (2) years which would have remained in the position’s term.

C. If any Tribal Council vacancy represents a seat that is up for election at midterm because of a vacancy, the individual winning a position on the Tribal Council by the lowest number of votes shall serve only a two (2) year term.

D. For purposes of term limits, any two (2) or four (4) year term to which a candidate has been elected during a general election shall be counted in the computation of how many terms have been consecutively served by the candidate. Such an elected term shall be counted towards a term limit even in the event that the individual resigns or is removed from the elected position.

E. For purposes of term limits, periods of service of less than two (2) years following a special election or an appointment by the Chairperson shall not be counted in the computation of how many terms have been consecutively served by the candidate.

F. All outgoing elected officials shall continue in the offices to which they were elected until 11:59 p.m. on the Sunday immediately after the election results have been announced. The elected officials during this period will do only administrative work that is deemed necessary to maintain the government operations.

G. In the event the office of the Chairperson becomes vacant for any reason between the initiation of the runoff election and 11:59 p.m. on Sunday after the runoff election results have been announced, the position of Chairperson shall not be filled by the Vice-Chairperson, and instead the Constitution’s Article V, Section 1 powers of the Chairperson shall be deemed to be duly delegated to the Vice-Chairperson until 11:59 p.m. on Sunday after the runoff election results have been announced in order to avoid an incongruous application of Article X, Section 2 of the Constitution (which provides that a vacancy in the position of Chairperson shall be filled by the Vice-Chairperson) during the interim period when the Tribe is awaiting announcement of the runoff election results.
