In this chapter, unless a different meaning is clearly required:

“Act” means this chapter.

“Breach of the peace” means conduct destroying or menacing public order and tranquility and may include acts of violence or acts or words likely to produce violence as well as acts or conduct that threaten the public peace.

“Casino” means the Sky River Casino, the gaming facility owned and operated by the Tribe or the Wilton Rancheria Gaming Authority.

“Citation” means a form of notice given to any person upon violation of this chapter.

“Confidential information” means nonpublic information related to the Tribe, the Tribal Government, its present or future business, or tribal members.

“Controlled substance” means any drug or other substance under the provisions of 21 U.S.C. § 802, “controlled substance.”

“Dangerous weapon” means any weapon, device, material or substance, whether animate or inanimate, which in the manner it is used or intended to be used is known to be capable of producing death or serious bodily injury.

“Defamation” means an intentionally false communication that injures another’s reputation.

“Firearm” means any device designed to be used as a weapon, from which is expelled through a barrel a projectile by the force of an explosion or other form of combustion.

“Harassment” means aggressive pressure or intimidation in person or on social media platforms.

“Misrepresentation” means any statements by one (1) person to another person, either in person, written or by social media, that is untrue or a false representation of the facts.

“Narcotics” means any drug under the provision of 21 U.S.C. § 802, “narcotic drug.”

“Person(s)” means any individual or entity, whether Indian or non-Indian or any group of individuals and any other Indian tribe, band or group.

“Petitioner” means the person who submits a request for hearing to the Tribal Court pursuant to this chapter.

“Probable cause” exists when facts and circumstances would lead to a reasonable person to believe that a person has committed, is committing, or is about to commit a violation of this chapter.

“Request for hearing” means the written request for hearing submitted to contest a citation pursuant to this chapter.

“Schedule of fines” means the minimum monetary penalties assigned to violations described in this chapter.

“Social media” means, collectively, all the technological means, especially websites and applications, and video conferencing systems for meetings that enable people to participate in Internet content creation and online networking.

“Tribal Council” has the same meaning as under Article VI of the Constitution.

“Tribal lands” means all territory set forth in Article II, Section 1 of the Constitution.

“Tribal Peace Officer” means a person designated to enforce this chapter as described in this chapter.

“Tribe” means the Wilton Rancheria, a federally recognized Indian tribe. (Res. 2023-04; Res. 2022-47 (Exh. A); Res. 2020-92; Res. 2020-07)
