Article IV. Offenses Against Persons

No person shall commit assault or battery towards another person, nor shall any person be allowed to threaten to commit an assault or battery on another person. Any personal grievance should be handled in accordance with this chapter so as to not reach the point of verbal and/or physical action, or threats to commit the same.

A. Assault. A person commits assault if they:

1. Knowingly or purposefully cause harm to another;

2. Negligently cause bodily harm to another;

3. Knowingly or purposely make physical contact of an insulting or provoking nature with an individual; or

4. Aid, assist, command, or counsel another to commit assault.

B. Aggravated Assault. A person commits aggravated assault if they knowingly or purposely cause:

1. Serious bodily harm to another;

2. Bodily harm to another with a weapon;

3. Bodily harm to tribal officials, tribal employees, or law enforcement officers lawfully discharging an official duty; or

4. Aids, assists, commands, or counsels another to commit aggravated assault.

C. Battery. A person commits battery if they:

1. Threaten another with imminent or serious bodily injury;

2. Make contact with another in a rude or offensive manner even if injury is slight; or

3. Cause physical contact with another when the person knows or should reasonably believe that the person will regard the contact as offensive or provocative. (Res. 2022-47 (Exh. A); Res. 2020-92; Res. 2020-07)
