A. The Department of Housing shall not disclose the names and personal information of those individuals requesting or receiving services from the Department, unless such a disclosure is:

1. Required by applicable law or court order;

2. Authorized by tribal law or by resolution of the Tribal Council;

3. Necessary to complete the duties, responsibilities, and requirements of the Department of Housing;

4. Provided to an employee, as defined by the Employment Act of 2014, with a need to know;

5. Provided to a consortium, organization, association, or other entity or body that meets the requirements of Section 1-202(B)(1) for the purposes of furthering or facilitating such an organization’s responsibilities; or

6. A necessary part of an investigation of any file by the Department of Housing.

B. Nothing in this section shall prohibit the Tribe or the Department of Housing from releasing the names or personal information of those individuals requesting or receiving services from the Department of Housing if such a release is for use in any tribal, state, or federal court action that is directly or indirectly related to the individual who has requested or is receiving services from the Department of Housing.
