A. The Tribal Court shall conduct a hearing within fifteen (15) business days after the filing of the petition of abuse to determine whether the preponderance of the evidence supports the conclusion that the protected individual is a victim of abuse.

B. The Tribal Court shall issue a summons for the protected individual, the protected individual’s caretaker, and all persons alleged to have committed the abuse to appear at the hearing.

C. The Tribal Court shall provide notice of the hearing to the Chairperson, Director of the Department of Social Services, and the protected individual’s family, including the protected individual’s guardians, caretakers, parents, grandparents, spouse, siblings and children. The Tribal Court shall have discretion to notice any additional party necessary for the proper adjudication of the case.

D. During the hearing, the Tribal Court shall advise the parties attending the hearing of the reason for the hearing and their basic rights. (Res. 2023-59)
