Article III. Petition of Abuse

A. Any person, including the Tribe, may file a written petition of abuse, asserting abuse against a protected individual or potential abuse against a prospective protected individual, with the Tribal Court.

B. The petition of abuse shall set forth the following, if known, with specificity:

1. The name, birth date, gender, address, and tribal affiliation of the protected individual or prospective protected individual;

2. The basis for the Tribal Court’s jurisdiction;

3. The allegations and facts that support the finding that the protected individual is a victim of abuse or the prospective protected individual is a victim of potential abuse;

4. The name, address and tribal affiliation of the caretaker of the protected individual or prospective protected individual;

5. The names, addresses and tribal affiliation of all members of the extended family and former caregivers of the protected individual or prospective protected individual;

6. The name, addresses, and tribal affiliation of the person(s) alleged to have committed the abuse or potential abuse. (Res. 2023-59)
