Pursuant to the compact, all formal written claims under this chapter shall be decided in a manner consistent with California tort law governing claims for bodily injury, personal injury, or property damage arising out of, connected with, or relating to the operation of the Gaming Authority, gaming facility, or gaming activities, including but not limited to injuries resulting from entry onto the Tribe’s land for purposes of patronizing the gaming facility or providing goods or services to the gaming facility; provided, however, any and all laws governing punitive damages, attorney’s fees or costs, whether under California law or otherwise, shall not be applicable to any formal written claim or appeal raised under this chapter. This chapter does not constitute general consent to California law, nor is it a waiver of the Tribe’s or the Gaming Authority’s sovereign immunity from unconsented suit or legal process.
