Article II. Development Committee

A. In furtherance of development of a Class III gaming facility, the Tribe participates in a Development Committee pursuant to its development agreement with Boyd Gaming. As this Development Committee is an outside committee not created by laws of the Tribal Council pursuant to the Constitution of Wilton Rancheria, the general prohibition against members of the Tribal Council serving on tribal committees shall not apply to participation in the Development Committee.

B. Pursuant to Article V, Section 1(b) of the Constitution, the Chairperson shall represent the Tribe on all matters that concern its interest and welfare. As a result, the Chairperson shall have a permanent seat on the Development Committee. The Vice-Chairperson may serve as an alternate for the Chairperson in any meeting of the Development Committee that the Chairperson so delegates such authority. The Chairperson, or the Vice-Chairperson when so delegated, shall be entitled to vote upon issues before the Development Committee in his or her sole and reasonable discretion and irrespective of the position of the Tribal Council on such issues.

C. Each year, at the first Tribal Council meeting following the General Council’s annual meeting, the Tribal Council will select from its membership one (1) representative and one (1) alternate to serve as a member of the Development Committee for the following year; provided, however, the Tribal Council may change its representative and alternate to the Development Committee at any time. The Tribal Council shall review and make a decision upon any matter upon which there shall be a substantive vote in the Development Committee. The member of the Development Committee from the Tribal Council shall then vote in that matter consistent with the decision of the Tribal Council.

D. Whether or not the Chairperson, Vice-Chairperson, or member of the Tribal Council is serving as a member or alternate of the Development Committee, such persons shall be entitled to attend and participate in meetings of the Development Committee. However, no person who is not a member or alternate of the Development Committee shall be entitled to vote in said meetings. (Res. 2023-04 (Exh. A); Res. 2015-25)
