The following types of orders are subject to appeal:

A. Final decisions issued by the Tribal Court that contain findings of fact and conclusions of law by written order.

B. Nonfinal orders issued by the Tribal Court that authorize the parties to appeal the decision to the Appellate Panel by written order. Appeals from nonfinal orders are permitted only in the discretion of the Court and only if (1) the order appealed from involves a controlling question of law as to which there is a substantial ground for difference in opinion; and (2) an immediate appeal from the order will materially advance the ultimate termination of the litigation.
