A party that files a petition regarding a constitutional question shall:

A. File its petition with the Court Clerk stating the constitutional question or questions and identifying the circumstances giving rise to the question.

B. Upon filing a petition:

1. Cases shall be numbered with the prefix CON and numbered sequentially;

2. The Court Clerk shall provide a file stamped copy of the petition and, if requested, a blank certificate of service form to the petitioner and deliver a copy of the petition to the Chief Judge; and

3. The petitioner shall, within seven (7) days of filing, serve the petition on interested parties and file a completed proof of service with the Court Clerk. Failure to file proof of service without good cause may result in an order to show cause as to why the petition should not be dismissed.

4. The petitioner is responsible for arranging a third party over the age of eighteen (18) and not the Chairperson or a member of the Tribal Council to serve the petition on the other interested party. (Res. 2020-71)
