Article II. Regulation of Burial Fund

A. The following procedures will be used to comply with the requirements of this chapter, provide for a fair and equitable process, and provide accountability for the program.

B. Organizational Responsibility. Responsibility for implementation of this chapter and operation of the program will be the following offices’ in the Tribal Governmental organization:

1. Enrollment Office. The Enrollment Officer will be responsible for operation of the burial fund program. In addition, the Enrollment Office will keep an interim record of expenditures for each member from the burial fund.

2. Finance Office. The Executive Director of Finance will be responsible for a final accounting of funds used for providing memorial, funeral, and burial benefits.

C. Representative’s Responsibility.

1. The representative, as the contact person, is responsible for assuring that the Enrollment Office is notified of the representative’s intent to access the burial fund for eligible costs and for assuring the memorial, funeral, and burial arrangements are made.

2. The representative must provide the name and address of all funeral and burial service providers.

D. Deadline.

1. The representative must notify the Enrollment Officer as soon as practicable of the death of an eligible person.

2. All burial benefit payments must be made within six (6) months of death.

E. Processing the Request. The following process is to be used to handle the request and make payment for the memorial, funeral, and burial costs:

1. The Enrollment Officer will review the request received from the representative to assure that all information needed is provided.

2. The Enrollment Officer will notify the Executive Director of Finance regarding the intent to access the burial benefit.

3. The Enrollment Officer and Executive Director of Finance may assist the representative and funeral services provider to determine the services provided, the costs to be paid, and arrangement for payment.

4. The Enrollment Officer and Executive Director of Finance will follow the appropriate policies and procedures of the Tribal Office. (Res. 2023-04; Res. 2015-17)
