The Constitution prescribes for general elections, runoff elections, special elections and amendment elections.

A. General Elections.

1. General elections shall be held in accordance with Article IX, Section 1 of the Constitution which states:

General Elections shall be held during the second weekend in June of even-numbered years beginning in 2014. General Elections shall be held in conjunction with the General Council’s Annual Meeting. The Chairperson, Vice-Chairperson, and members of the Tribal Council shall be selected at the General Elections. All elected officials shall take office at a point in time after the announcement of all Election results, including the results of any Run-Off Elections, on the Monday immediately following the Election.

2. As required by Article VII, Section 3 of the Constitution, the General Council’s annual meeting shall be held in conjunction with general elections during the second weekend in June. The annual meeting may include meeting by electronic video screen communication, or other live streaming communications equipment, to allow greater tribal member participation. The annual meeting will have reasonable and sufficient notice, set agenda, and quorum requirements consistent with Sections 3-203 and 3-204.

B. Runoff Elections. Runoff elections shall occur in the following circumstances:

1. The top two (2) candidates in a general election for the position of Chairperson or Vice-Chairperson shall participate in a runoff election if after the general election no candidate receives the required fifty percent (50%) plus one (1) of the total votes cast to be deemed as the winner. The runoff election shall have three (3) or more candidates if two (2) or more candidates have a tied vote in receiving the second most number of votes in a general election.

2. In any election when there is a tied vote amongst the candidates who received the highest number of votes.

C. Special Elections.

1. In the event that the positions of Chairperson and Vice-Chairperson are both vacant for any reason, a special election shall be called by the Election Commission to fill the position of Chairperson.

2. The special election shall also include a special election runoff if the special election ends in a tie or if no candidate receives a majority of the vote. The special election runoff shall include only the two (2) candidates who have a tied vote or the two (2) candidates who have received the highest number of votes in the special election for Chairperson. The special election runoff shall have three (3) or more candidates if two (2) or more candidates have a tied vote in receiving the second most number of votes in a general election.

D. Amendment Elections.

1. Pursuant to Article XIV, Section 1 of the Constitution, the Constitution may be amended by a two-thirds (⅔) vote at a special meeting of the General Council called for that purpose and at which a quorum is present.

2. Pursuant to Article XIV, Section 2 of the Constitution, the Chairperson shall call and hold an election to amend the Constitution at the request of two-thirds (⅔) of the entire Tribal Council, at the request of the General Council, or upon the presentation of a petition signed by thirty percent (30%) of the eligible voters.

3. An amendment election shall be conducted by the Election Commission to vote on proposed amendments to the Constitution. The special meeting will have reasonable and sufficient notice, set agenda, and quorum requirements consistent with Article IV of Chapter 3 of this title, General Council.
