A. Tribal Council.

1. The Tribal Council shall consist of seven (7) members elected by a vote of the Tribe’s eligible voters.

2. Members of the Tribal Council shall serve four (4) year terms that shall be staggered consistent with Section 4-404.

3. Candidates elected or appointed as members of the Tribal Council who are employed in a Tribal Government position or who hold another elected or appointed public office in the Tribe must resign such other employment or office before being seated on the Tribal Council. Members of the Tribal Council shall hold no other Tribal Government employment or public office with the Tribe during their terms of office. Members of the Tribal Council are eligible to work as employees of the Tribe’s enterprises or businesses. No Tribal Council member shall be employed by the Tribe until an Elected Official Employment Act is enacted.*

4. Candidates elected or appointed as members of the Tribal Council who are serving on a tribal committee or board must resign such membership before being seated on the Tribal Council. Members of the Tribal Council shall hold membership with no other tribal committee or board during their terms of office. For purposes of this section, a “tribal committee or board” does not include committees, boards or representative designations that (a) include other individuals outside of the Tribe; (b) are on behalf of a non-Wilton Rancheria entity; or (c) are otherwise authorized by the Tribal Council by resolution. Members of the Tribal Council may serve on the Board of Directors of the Wilton Rancheria Gaming Authority in accordance with its charter, other similar appointments or as ex officio members as described in 4 WRC § 1-101 et seq., Tribal Council, as amended.

B. Chairperson/Vice-Chairperson.

1. The Chairperson and Vice-Chairperson shall be elected by a majority vote of the Tribe’s eligible voters.

2. The Chairperson and Vice-Chairperson shall serve staggered four (4) year terms.

3. Candidates elected or appointed as Chairperson or Vice-Chairperson who hold another elected or appointed public office in the Tribe must resign such other office before being seated as Chairperson or Vice-Chairperson. A Chairperson or Vice-Chairperson shall hold no other public office with the Tribe during his or her term of office. No Chairperson or Vice-Chairperson shall be employed by the Tribe until an Elected Official Employment Act is enacted.*

4. Candidates elected or appointed as Chairperson or Vice-Chairperson who are serving on a tribal committee or board must resign such membership before being seated. Neither the Chairperson nor the Vice-Chairperson shall hold membership with a tribal committee or board during his or her term of office. For purposes of this section, a “tribal committee or board” does not include committees, boards or representative designations that (a) include other individuals outside of the Tribe; (b) are on behalf of a non-Wilton Rancheria entity; or (c) are otherwise authorized by the Tribal Council by resolution. The Chairperson and Vice-Chairperson may serve on the Board of Directors of the Wilton Rancheria Gaming Authority in accordance with its charter and other similar appointments as approved by the Tribal Council by resolution.
