A. Violations.

1. It shall be unlawful for an individual who is not a member of the Tribe, any outside organization or business, or any other tribe to make:

a. A contribution or donation of money or other thing of value, or to make an express or implied promise to make a contribution or donation, in connection with an election;

b. A contribution or donation to a candidate for office; or

c. An expenditure or disbursement for an electioneering communication.

2. It shall be unlawful for a person to solicit, accept or receive a contribution or donation described in this subsection (A) from an individual who is not a member of the Tribe, any outside organization or business, or any other tribe.

3. Upon the filing of a complaint with the Election Commission alleging a violation of this subsection (A), the Election Commission may investigate and conduct a hearing to determine whether a violation has occurred. Such determination and any penalty imposed can be appealed to the Tribal Court.

B. Penalties. In addition to any other fine or penalty provided by the Tribe’s other laws, whoever violates subsection (A) of this section may be assessed any of the following by the Election Commission:

1. A fine not to exceed ten thousand dollars ($10,000.00).
