A. Violations.

1. It shall be an election offense for any person to verbally or physically threaten a member of the Election Commission, a poll worker, candidate or another eligible voter, including but not limited to: engaging in bullying, hate speech, threatening physical harm or disparaging statements on social media.

2. It shall be an election offense for any person to intentionally tamper with the voting process including, but not limited to: voting more than once in the same election, posing as another person for the purpose of voting at an election, altering a ballot, fraudulently using the absentee vote process and forging or falsifying documents related to an election.

3. It shall be an election offense for any elected official or candidate to manipulate or disrupt the Election Commission or voting process including, but not limited to: coercing or bribing any Election Commission officials and/or the manipulation, coercion, or bribing of any voter prior to voting.

4. Upon the filing of a complaint with the Election Commission alleging an election offense, the Election Commission may investigate and conduct a hearing to determine whether an election offense has been committed. Such determination and any penalty imposed can be appealed to the Tribal Court.

5. Nothing herein is intended to limit the application of 5 WRC § 4-101 et seq., Peace and Security, and all the remedies that are provided for therein.

B. Penalties.

1. In addition to any other fine or penalty provided by the Tribe’s other laws, whoever violates this chapter may be assessed any of the following:

a. A fine not to exceed ten thousand dollars ($10,000.00).

b. Additional costs to the Tribe resulting from the violation as determined by the Election Commission.

2. If someone is violating subsection (A) of this section they will be removed from the premises and cannot vote.

3. Ballots received under violation of subsection (A)(2) of this section shall be declared void by the Election Commission. (Res. 2021-54; Res. 2020-14; Res. 2015-24; Res. 2014-41; Res. 2013-60; Res. 2013-57)
